Terms of Use

1. Acceptance

By downloading, installing, accessing, purchasing, or using Arrival, you agree to these Terms, the Privacy Policy, the EULA, and any additional rules shown in the app. If you do not agree, do not use the app.

2. What Arrival does

Arrival helps you set a destination, track trip progress, and receive an alert when you are near your destination. If you grant permissions, Arrival may use location, including background location during active tracking, plus notifications and optional Live Activities to provide this functionality.

3. No account required

Arrival does not require you to create an account for core use. Some preferences, recent places, or trip-related history may be stored locally on your device.

4. Permissions and your responsibilities

Location. If location access is limited, inaccurate, delayed, blocked, or disabled, tracking and alerts may not function correctly.

Notifications. Notifications are strongly recommended because Arrival relies on alerts to notify you near your destination. Device settings may prevent notifications from appearing, sounding, vibrating, or being noticed.

Device conditions. Performance depends on factors outside our control, including GPS accuracy, tunnels, dense buildings, signal or network availability, device volume or silent settings, Focus modes, notification settings, battery level, Low Power Mode, iOS limitations, and Apple service availability.

5. Safety disclaimer

Arrival is a convenience tool, not a safety, emergency, navigation, railway, aviation, medical, workplace, or time-critical system. It is not guaranteed to wake you, alert you, or prevent missed stops, appointments, transport connections, penalties, accidents, loss, or harm.

Do not rely on Arrival where failure, delay, inaccuracy, or missed notification could cause personal injury, legal issues, financial loss, or serious inconvenience. You remain responsible for your travel choices, timing, surroundings, belongings, and personal safety.

6. Acceptable use

• Do not use the app in violation of any law or regulation.
• Do not circumvent paywalls, entitlement checks, subscription checks, or security features.
• Do not reverse engineer, decompile, disassemble, inspect source code, or attempt to extract source code except where permitted by law.
• Do not interfere with, overload, misuse, or disrupt the app, its performance, platform services, or other users' access.

7. Intellectual property

Arrival, KitVa, app designs, software, branding, interfaces, text, graphics, and related content are owned by us or our licensors. You receive only the limited rights stated in these Terms and the EULA.

8. Third-party services

Arrival may use Apple technologies and services, including MapKit, iOS location services, notifications, Live Activities, StoreKit, App Store billing, and other platform services. Your use of those services may be subject to Apple terms and privacy practices. We are not responsible for third-party service failures outside our control.

9. Premium features, purchases, and subscriptions

Arrival may offer Premium access through the following App Store products:

• 3-month auto-renewing subscription
• 1-year auto-renewing subscription
• Lifetime access as a one-time purchase

Auto-renewing subscriptions. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless cancelled through Apple before renewal under Apple's rules. Your account may be charged before the next period begins.

Lifetime access. Lifetime means the lifetime of the Arrival app and its availability on the App Store, not the lifetime of the user, any specific device, or any third-party platform.

Managing subscriptions. You can manage or cancel subscriptions through Apple ID subscription settings or Apple's subscription-management flow. Deleting the app does not cancel a subscription.

Refunds. Purchases, prices, taxes, billing, cancellations, and refund eligibility for App Store transactions are handled by Apple under Apple policies. KitVa cannot directly refund App Store transactions unless Apple provides a specific mechanism for us to do so.

10. Changes to the app, pricing, and Terms

We may update, modify, suspend, limit, remove, or discontinue parts of the app, including features, Premium offerings, supported regions, languages, integrations, pricing references, and these Terms. App Store price tiers, taxes, currency, and renewal handling may be controlled by Apple.

11. Disclaimer of warranties

To the maximum extent permitted by law, Arrival is provided as is and as available, without warranties of any kind. We do not guarantee that tracking, alerts, notifications, Live Activities, ETA or progress, map results, purchase entitlements, or third-party services will be accurate, timely, uninterrupted, secure, or error-free.

Software and connected services may contain bugs, delays, outages, incorrect location readings, missed notifications, entitlement errors, data loss, compatibility issues, or other defects.

12. Limitation of liability

To the maximum extent permitted by law, KitVa Limited is not liable for indirect, incidental, special, consequential, punitive, or exemplary loss, or for loss of profit, revenue, goodwill, data, expected savings, travel opportunity, bookings, connections, tickets, or productivity arising from Arrival.

To the maximum extent permitted by law, KitVa Limited's aggregate liability for claims relating to paid Arrival features is limited to the amount you paid through Apple for the relevant Arrival product during the three months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded or limited under applicable law.

13. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, subject to any mandatory laws that apply to you.
