Terms of Use
These Terms apply to BookMay, BookMay Business, and related booking services provided by KitVa Limited.
1. Acceptance
By downloading, accessing, creating an account, listing a business, making a booking, sending a message, or otherwise using BookMay, you agree to these Terms, the Privacy Policy, the EULA, and any additional rules shown in the app.
If you use BookMay for a business, you confirm that you are authorized to bind that business and manage its listing, bookings, staff, services, images, communications, and customer records.
2. What BookMay does
BookMay helps customers discover service businesses, view services, unlock private shops, make booking requests, manage bookings, receive updates, chat with businesses, and leave reviews.
BookMay Business helps businesses manage shop profiles, images, services, staff, hours, day offs, booking journeys, approval rules, manual bookings, inbox messages, reviews, QR store codes, and related operations.
3. Platform role and independent businesses
BookMay is a booking and communication platform. Unless expressly stated otherwise, KitVa does not provide the services listed by businesses, employ the staff shown on business profiles, set business prices, or control how a business performs its services.
Each business is responsible for its own descriptions, prices, availability, qualifications, licences, permits, service quality, customer handling, deposits, refunds, tax, and compliance with laws that apply to its services.
4. Accounts and accurate information
- You must provide accurate, current, and complete information when creating an account, listing a business, or making a booking.
- You are responsible for keeping your login credentials secure and for activities under your account.
- You must not impersonate another person, misrepresent a business, or use another account without permission.
- If you create or manage a business account, you must be the owner, an authorized officer, or a person expressly authorized by the real business to create listings, accept bookings, communicate with customers, and manage payments or subscriptions.
5. Business identity, verification, and anti-impersonation
You must not create, claim, list, or manage a business profile for a shop, clinic, restaurant, studio, brand, address, phone number, staff member, trade mark, or business name that you do not own or have authority to represent.
We may require verification at any time, including business registration information, licence or permit information, proof of address, proof of phone or email control, trade mark or brand authorization, owner authorization, or other evidence we reasonably request.
If we suspect impersonation, passing off, false business information, malicious booking activity, or unauthorized use of another merchant's identity, we may hide the listing, pause bookings, notify affected users or businesses, preserve records, request more evidence, and suspend or terminate the account while we investigate.
6. Customer responsibilities
- Check service details, price information, booking time, location, cancellation cutoff, approval status, and any business-specific rules before confirming a booking.
- Attend bookings on time, provide accurate contact details, and update or cancel bookings through the app where available.
- Use chat, reviews, QR access, and private shop features lawfully, respectfully, and only for genuine booking-related purposes.
7. Business responsibilities
- Keep shop profiles, services, staff, images, pricing, availability, locations, phone numbers, booking rules, and cancellation terms accurate and up to date.
- Only upload images, logos, descriptions, and content that you own or have permission to use.
- Promptly manage pending bookings, customer messages, refunds, complaints, no-shows, cancellations, and review replies.
- Comply with all laws, licences, permits, professional rules, consumer protection rules, privacy obligations, tax obligations, and industry requirements that apply to your business.
8. Bookings, approval, cancellation, and status
A booking may be pending, confirmed, completed, or cancelled. Some businesses may require approval before a booking is confirmed. Availability depends on business hours, service duration, staff, day offs, capacity, existing bookings, and system availability.
Cancellation rules may vary by business and may include a cutoff period. Customers and businesses remain responsible for resolving service-specific changes, late arrivals, no-shows, refunds, and disputes.
9. Private shops, QR codes, and access codes
Businesses may use store codes, QR codes, or access codes to help customers find or unlock private shops. Do not share private access codes without permission. We may disable codes, shops, or accounts where misuse, fraud, or security risk is suspected.
10. User content, chat, and reviews
You are responsible for content you submit, including messages, notes, images, business listings, review comments, and replies. Do not submit unlawful, misleading, abusive, defamatory, infringing, confidential, obscene, spam, or malicious content.
You grant us a non-exclusive licence to host, store, display, transmit, process, and use submitted content as needed to operate, support, secure, and improve BookMay.
11. Payments, deposits, subscriptions, and refunds
BookMay may support booking deposits, business payments, app purchases, subscriptions, or other paid features. Payment terms, renewal terms, cancellation terms, and refund paths may depend on the business, payment provider, app store, or plan shown at checkout.
For service bookings, the business is normally responsible for its service pricing, deposit handling, and refund decisions unless BookMay expressly states otherwise.
12. Prohibited conduct
- Do not access BookMay unlawfully, interfere with security, scrape data, overload systems, or attempt unauthorized access.
- Do not reverse engineer, decompile, copy, modify, resell, or exploit the apps except where allowed by law.
- Do not use BookMay for fake bookings, spam, harassment, fraud, money laundering, illegal services, or unlawful discrimination.
- Do not impersonate, claim, or operate another business or merchant account without authority.
- Do not create fake availability, fake prices, fake staff, fake addresses, fake QR or store-code access, or bookings that the real business has not accepted.
- Do not use BookMay to misdirect customers, damage a competitor, harvest customer data, create bad-faith reviews, or interfere with another merchant's operations.
- Do not upload another business's logo, photos, trade marks, business name, phone number, address, staff details, or service descriptions without authority.
13. Availability and changes
We may update, suspend, limit, remove, or discontinue features, listings, accounts, countries, languages, booking types, integrations, paid features, or these Terms. BookMay may be unavailable because of maintenance, network issues, service providers, device settings, or events outside our control.
14. Intellectual property
BookMay, BookMay Business, KitVa, app designs, software, branding, and related content are owned by us or our licensors. You receive only the limited rights stated in these Terms and the EULA.
15. Indemnity
To the maximum extent permitted by law, you agree to compensate and hold KitVa Limited harmless from claims, losses, liabilities, refunds, chargebacks, penalties, investigation costs, and reasonable legal costs arising from your breach, false listing, unauthorized business account, misleading booking, infringing content, misuse of customer data, or misuse of BookMay.
16. Disclaimer
To the maximum extent permitted by law, BookMay is provided as is and as available. We do not guarantee that listings, prices, availability, locations, messages, reviews, notifications, QR access, booking results, or third-party services will be accurate, complete, timely, uninterrupted, or error-free.
17. Limitation of liability
To the maximum extent permitted by law, KitVa Limited is not liable for indirect, incidental, special, consequential, punitive, or exemplary loss, or for loss of profit, revenue, goodwill, data, bookings, business opportunity, or expected savings arising from BookMay.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
18. Suspension and termination
We may suspend or terminate access to BookMay, remove content, hide listings, disable QR or private access, or restrict features if we believe there is a breach of these Terms, legal risk, security risk, fraud, abuse, or harm to customers, businesses, KitVa, or the platform.
19. Fraud, impersonation, malicious bookings, and enforcement
If we determine, or reasonably suspect, that an account was used to impersonate a business, register another merchant's shop without authority, create fake or malicious bookings, mislead customers into attending a booking not accepted by the real business, damage another merchant's reputation, or otherwise commit fraud or abuse, we may immediately suspend or permanently ban the account, remove listings, cancel related bookings, disable store codes, and terminate access to paid features.
To the maximum extent permitted by law and applicable app-store, subscription, and payment-provider rules, fees paid for the affected account, plan, subscription, setup, or paid features will not be refunded or credited where access is suspended or terminated for fraud, impersonation, malicious bookings, or material breach.
We may preserve records, disclose information to affected customers, the real business, payment providers, app stores, regulators, law enforcement, or courts where legally permitted or required, and seek recovery of losses, refunds, chargebacks, investigation costs, legal costs, and other remedies available under law.
20. Governing law and jurisdiction
These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have non-exclusive jurisdiction, subject to any mandatory consumer rights that apply where you live.
