BookMay Business
End User License Agreement
This EULA governs your licence to install and use the BookMay Business merchant app and related software.
1. Relationship with other terms
This EULA forms part of the BookMay Business Terms of Use. If there is a conflict about software licence rights, this EULA controls for the software licence only. The Terms of Use continue to govern accounts, listings, bookings, staff access, customer data, content, payments, and platform use.
2. Licence grant
Subject to your compliance with this EULA and the Terms of Use, KitVa Limited grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use BookMay Business on compatible Apple-branded devices you own or control, as permitted by Apple rules and applicable law.
You may use BookMay Business for internal business booking operations, including managing shop profiles, services, staff, availability, customer communications, bookings, and reviews, subject to your account permissions and these terms.
3. Business users and role permissions
BookMay Business may support owner, manager, and staff roles. Business owners are responsible for granting, reviewing, and removing access for their team members and for actions taken through their business account.
4. Restrictions
- Do not copy, modify, adapt, translate, create derivative works from, distribute, rent, lease, lend, sell, sublicense, or otherwise exploit the software except as allowed by law.
- Do not reverse engineer, decompile, disassemble, inspect source code, bypass technical protections, or interfere with security except where applicable law expressly permits.
- Do not remove proprietary notices, use the software to build a competing product, or use automated systems to extract data from BookMay Business.
- Do not use the software to impersonate a business, claim a shop without authority, create malicious bookings, harvest customer data, upload infringing business content, or misdirect customers to a booking not accepted by the real business.
- Do not use the software in a way that breaches law, platform rules, third-party rights, privacy obligations, or the BookMay Business Terms of Use.
5. Updates and compatibility
We may provide updates that add, change, suspend, or remove features. Some updates may be required for security, compatibility, legal compliance, backend changes, app-store requirements, or continued use. We do not guarantee support for every device, operating system version, region, language, account role, or integration.
6. Third-party services
The software may rely on Apple services, cloud hosting, authentication, database, storage, maps, notifications, payment providers, email providers, analytics, diagnostics, and other third-party services. Third-party terms and privacy practices may apply. We are not responsible for third-party service failures outside our control.
7. Ownership
The software is licensed, not sold. KitVa Limited and its licensors retain all rights, title, and interest in BookMay Business, BookMay, software, designs, branding, code, databases, interfaces, documentation, and related intellectual property.
8. Termination
This licence continues until terminated. It terminates automatically if you breach this EULA or the Terms of Use. We may also suspend or terminate the licence where necessary for security, legal compliance, fraud prevention, impersonation prevention, malicious booking response, platform integrity, or discontinued service. Upon termination, you must stop using and delete the software.
9. No warranty
To the maximum extent permitted by law, the software is provided as is and as available, without warranties of any kind. We do not guarantee that the software, booking availability, notifications, QR scanning, chat, images, business data, customer data, payment status, or third-party integrations will be uninterrupted, accurate, secure, or error-free.
10. Apple acknowledgements
- This EULA is between you and KitVa Limited, not Apple.
- Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for the app.
- If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, according to its policies.
- Apple is not responsible for product claims, consumer protection claims, intellectual property claims, or legal compliance claims relating to the app.
- Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you after you accept it.
11. Export and sanctions
You may not use, export, or re-export the software except as authorized by applicable export control, sanctions, and trade laws. You confirm that you are not located in a country or on a list where use of the software would be prohibited by applicable law.
12. Governing law
This EULA is governed by the laws of the Hong Kong Special Administrative Region, subject to any mandatory laws that apply to you.
