Terms of Use
These Terms apply to BookMay Business, the merchant app and related business booking services provided by KitVa Limited.
1. Acceptance and authority
By downloading, accessing, creating a business account, listing a business, managing bookings, sending messages, or otherwise using BookMay Business, you agree to these Terms, the Privacy Policy, the EULA, the Refund Policy, and any additional rules shown in the app.
If you use BookMay Business for a company, shop, partnership, sole proprietorship, brand, clinic, studio, or other organization, you confirm that you are authorized to bind that business and manage its listing, staff, services, images, messages, customer records, bookings, payment settings, subscriptions, and account permissions.
2. What BookMay Business does
BookMay Business helps merchants manage shop profiles, cover images, work galleries, services, staff, hours, day offs, booking approval rules, manual bookings, booking status, inbox messages, review replies, QR store codes, private shop access, and related operations.
BookMay Business works with BookMay, the customer app. Customers may discover a business, view services and prices, request bookings, receive reminders, send messages, use QR or store codes, and leave reviews.
3. Platform role and independent businesses
BookMay Business is a booking, communication, and business-management platform. Unless expressly stated otherwise, KitVa does not provide the services listed by businesses, employ the staff shown on business profiles, set business prices, verify every qualification, or control how a business performs its services.
Each business is responsible for its own descriptions, prices, availability, qualifications, licences, permits, service quality, customer handling, deposits, refunds, tax, records, staff conduct, and compliance with laws that apply to its services.
4. Business account and staff access
- Provide accurate, current, and complete information when creating an account, verifying authority, listing a business, or configuring services.
- Keep login credentials secure and promptly remove staff access that is no longer required.
- Use owner, manager, and staff permissions carefully and only grant access to authorized personnel.
- Remain responsible for actions taken through your business account, including by staff, agents, contractors, or anyone using your credentials.
- Do not impersonate another business, claim a listing without authority, or misrepresent your role.
5. Business identity, verification, and anti-impersonation
You must not create, claim, list, or manage a business profile for a shop, clinic, restaurant, studio, brand, address, phone number, staff member, trade mark, or business name that you do not own or have authority to represent.
We may require verification at any time, including business registration information, licence or permit information, proof of address, proof of phone or email control, trade mark or brand authorization, owner authorization, domain proof, shop-code evidence, or other evidence we reasonably request.
If we suspect impersonation, passing off, false business information, malicious booking activity, or unauthorized use of another merchant's identity, we may hide the listing, pause bookings, restrict staff permissions, notify affected users or businesses, preserve records, request more evidence, and suspend or terminate the account while we investigate.
6. Listings, services, prices, and legal compliance
Businesses must keep shop profiles, service descriptions, prices, images, staff details, availability, locations, phone numbers, opening hours, cancellation cutoffs, deposit terms, and booking rules accurate and up to date.
Business content must not be false, misleading, deceptive, infringing, unlawful, discriminatory, or unsafe. Businesses are responsible for complying with Hong Kong and other applicable laws, including consumer protection, trade description, licensing, professional, health and safety, privacy, employment, tax, and industry-specific requirements.
If a service requires a licence, permit, professional qualification, parental or guardian consent, health warning, safety information, or special customer notice, the business must handle those requirements itself.
7. Bookings, approval, cancellation, and manual entries
A booking may be pending, confirmed, completed, or cancelled. Availability depends on configured hours, service duration, staff, day offs, capacity, existing bookings, customer choices, and system availability.
Businesses must manage pending requests promptly, honor confirmed bookings where reasonably possible, communicate changes clearly, and handle late arrivals, no-shows, customer cancellations, business cancellations, rejection reasons, deposits, and refunds according to the relevant booking terms and applicable law.
Manual bookings should be entered only for genuine business purposes and with appropriate authority to record the customer details involved.
8. Customer data and privacy responsibilities
Businesses may receive customer contact details, booking details, notes, messages, reviews, images, and payment or deposit status. Businesses must protect that data, limit staff access, use it only for lawful booking, service, support, record-keeping, or other legitimate business purposes, and avoid unnecessary disclosure or export.
Do not use customer data from BookMay Business for unsolicited marketing, unrelated promotion, list building, resale, or disclosure to third parties unless you have a lawful basis and any required consent.
9. Private shops, QR codes, and access codes
Businesses may use store codes, QR codes, or access codes to help customers find or unlock private shops. You are responsible for distributing codes appropriately and notifying us if you suspect misuse, fraud, or unauthorized access.
We may disable codes, shops, listings, accounts, or features where misuse, fraud, security risk, or legal risk is suspected.
10. Content, chat, images, and reviews
You are responsible for business listings, service descriptions, staff details, images, messages, notes, review replies, and other content submitted through BookMay Business. Only upload content you own or have permission to use.
Do not submit unlawful, misleading, abusive, defamatory, infringing, confidential, obscene, spam, malicious, or discriminatory content. We may remove or limit content that we believe breaches these Terms or creates risk.
You grant us a non-exclusive licence to host, store, display, transmit, process, and use submitted content as needed to operate, support, secure, and improve BookMay and BookMay Business.
11. Payments, plans, deposits, subscriptions, and refunds
BookMay Business may support service deposits, business payments, app purchases, subscriptions, setup services, merchant plans, payment-provider transactions, or other paid features. Payment terms, renewal terms, cancellation terms, and refund paths may depend on the checkout screen, business plan, invoice, app store, payment provider, or written order terms.
For customer service bookings, the business is normally responsible for its service pricing, deposit handling, refund decisions, tax obligations, and customer dispute handling unless BookMay expressly states otherwise.
12. Prohibited conduct
- Do not access BookMay Business unlawfully, interfere with security, scrape data, overload systems, or attempt unauthorized access.
- Do not reverse engineer, decompile, copy, modify, resell, or exploit the app except where allowed by law.
- Do not use BookMay Business for fake bookings, spam, harassment, fraud, money laundering, illegal services, unsafe services, or unlawful discrimination.
- Do not impersonate, claim, or operate another business or merchant account without authority.
- Do not create fake availability, fake prices, fake staff, fake addresses, fake QR or store-code access, or bookings that the real business has not accepted.
- Do not use BookMay Business to misdirect customers, damage a competitor, harvest customer data, create bad-faith reviews, or interfere with another merchant's operations.
- Do not bypass entitlement checks, payment flows, usage limits, staff permissions, privacy controls, or security features.
13. Availability and changes
We may update, suspend, limit, remove, or discontinue features, listings, accounts, countries, languages, booking types, integrations, paid features, or these Terms. BookMay Business may be unavailable because of maintenance, network issues, service providers, device settings, app-store requirements, or events outside our control.
14. Intellectual property
BookMay Business, BookMay, KitVa, app designs, software, branding, documentation, databases, and related content are owned by us or our licensors. You receive only the limited rights stated in these Terms and the EULA.
15. Indemnity
To the maximum extent permitted by law, you agree to compensate and hold KitVa Limited harmless from claims, losses, liabilities, refunds, chargebacks, penalties, investigation costs, and reasonable legal costs arising from your breach, false listing, unauthorized business account, misleading booking, infringing content, misuse of customer data, staff misuse, or misuse of BookMay Business.
16. Disclaimer
To the maximum extent permitted by law, BookMay Business is provided as is and as available. We do not guarantee that listings, prices, availability, locations, messages, reviews, notifications, QR access, booking results, customer attendance, payment-provider results, or third-party services will be accurate, complete, timely, uninterrupted, or error-free.
17. Limitation of liability
To the maximum extent permitted by law, KitVa Limited is not liable for indirect, incidental, special, consequential, punitive, or exemplary loss, or for loss of profit, revenue, goodwill, data, bookings, business opportunity, expected savings, customer relationships, or staff productivity arising from BookMay Business.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
18. Suspension and termination
We may suspend or terminate access to BookMay Business, remove content, hide listings, disable QR or private access, restrict staff permissions, or limit features if we believe there is a breach of these Terms, legal risk, security risk, fraud, abuse, or harm to customers, businesses, KitVa, or the platform.
19. Fraud, impersonation, malicious bookings, and enforcement
If we determine, or reasonably suspect, that an account was used to impersonate a business, register another merchant's shop without authority, create fake or malicious bookings, mislead customers into attending a booking not accepted by the real business, damage another merchant's reputation, or otherwise commit fraud or abuse, we may immediately suspend or permanently ban the account, remove listings, cancel related bookings, disable store codes, restrict staff access, and terminate access to paid features.
To the maximum extent permitted by law and applicable app-store, subscription, and payment-provider rules, fees paid for the affected account, plan, subscription, setup, onboarding, support package, or paid features will not be refunded or credited where access is suspended or terminated for fraud, impersonation, malicious bookings, or material breach.
We may preserve records, disclose information to affected customers, the real business, payment providers, app stores, regulators, law enforcement, or courts where legally permitted or required, and seek recovery of losses, refunds, chargebacks, investigation costs, legal costs, and other remedies available under law.
20. Governing law and jurisdiction
These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have non-exclusive jurisdiction, subject to any mandatory rights or laws that apply to you or the relevant transaction.
