iWalkie Terms of Use

1. Agreement
These Terms of Use form an agreement between you and KitVa Limited concerning iWalkie. By downloading, accessing, creating an account for, or using iWalkie, you agree to these Terms, the Privacy Policy, and the End User License Agreement. If you do not agree, do not use iWalkie.
2. The service
iWalkie is an internet-based push-to-talk service for friends, teams, and small groups. It supports accounts, friendships, channels, live presence, one active speaker at a time, and real-time voice on compatible Apple devices.
An account and internet connection are required. Voice sessions operate while the app is open. The Apple Watch app controls a paired iPhone and does not transmit voice independently.
3. Your account
You sign in through Apple and are responsible for activity under your account and devices. Keep your devices, Apple account, and authentication credentials secure. Tell us promptly if you suspect unauthorised access.
Your display name and iWalkie handle must not impersonate another person, mislead others, infringe rights, or contain unlawful or abusive material. You must be legally capable of agreeing to these Terms, or use the service with permission and supervision from a parent or guardian where required.
4. Channels, friends, and codes
Group channels may be created or joined using a code and can contain up to 50 stored members. Accepted friends receive a private direct channel. You are responsible for sharing channel codes only with intended participants and for managing channels you create.
Do not assume that a code or channel is confidential merely because it is not publicly listed. A participant can disclose a code, allow others to hear their device, or capture audio by means outside iWalkie.
5. Acceptable use
You must use iWalkie lawfully and respectfully. You must not:
- harass, threaten, abuse, stalk, deceive, or impersonate another person;
- transmit unlawful, hateful, exploitative, infringing, or privacy-invasive speech or material;
- use the service for spam, unsolicited promotion, fraud, surveillance, or coordinated abuse;
- interfere with channel control, security, rate limits, authentication, or service infrastructure;
- reverse engineer, scrape, probe, automate, resell, or commercially exploit the service except where applicable law expressly permits it; or
- use iWalkie while operating a vehicle, equipment, or in any situation where distraction creates danger or violates law.
6. Voice and other users
iWalkie transports live microphone audio and does not record or store voice audio. Other participants hear what you transmit and remain responsible for their own conduct. We do not pre-screen live speech and cannot guarantee the identity, conduct, availability, or statements of another user.
7. Not an emergency service
iWalkie is not a telephone service, dispatch system, safety-critical radio, emergency communication service, or substitute for contacting emergency services. Do not rely on it where delayed, missing, or interrupted communication could cause harm. Always use the official emergency number and appropriate professional equipment for urgent or safety-critical needs.
8. Permissions, devices, and connectivity
You are responsible for compatible hardware, current system software, microphone and notification permissions, internet access, data charges, Bluetooth accessories, and safe audio levels. Network quality, device state, permissions, Apple services, Cloudflare, and LiveKit can affect operation.
9. Suspension and deletion
You may sign out or delete your account from iWalkie Settings. We may restrict, suspend, or terminate access where reasonably necessary to protect users or the service, investigate suspected abuse, comply with law, or enforce these Terms. We may also remove abandoned, unlawful, or technically harmful data.
10. Ownership and feedback
KitVa Limited and its licensors own iWalkie, including its software, design, branding, and service technology. These Terms do not transfer ownership to you. If you voluntarily provide feedback, you allow us to use it without restriction or payment, while we remain responsible for our use of personal data under the Privacy Policy.
11. Availability and changes
We may update, replace, limit, interrupt, or discontinue features or the service. We do not promise uninterrupted availability, permanent retention of channels, compatibility with every device or accessory, or delivery of every notification or voice session. We may update these Terms for operational, legal, security, or product reasons and will revise the effective date for material changes.
12. Disclaimers and liability
To the maximum extent permitted by applicable law, iWalkie is provided on an “as is” and “as available” basis without warranties of uninterrupted, error-free, secure, or fit-for-purpose operation. KitVa Limited is not liable for indirect, incidental, special, consequential, or punitive loss, lost communications, loss of data, or harm caused by reliance on another user or on service availability. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.
13. Governing law and contact
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without limiting any mandatory rights you may have under the law of your place of residence. Courts with lawful jurisdiction may hear disputes.
